- General Terms of Use
- Agreement
You agree that by clicking “Join Now”, “Join Hard Hat Hunter”, “Sign Up” or similar (collectively referred to as “Join”), by registering, by accessing or using our services (including Hard Hat Hunter and our related mobile apps, developed platforms, or any content or information provided as part of these services, collectively “Services”), you are entering into a legally binding agreement (even if you are using our Services on behalf of a company).
This “Agreement” includes this User Agreement and the Privacy Policy, together. This Agreement and its policies may be amended at any time by Hard Hat Hunter. If you do not agree to this Agreement, DO NOT join and do not access, or otherwise use, any of our Services.
- Safety
- Account Security
You are responsible for maintaining the confidentiality of your account, including profile and passwords. You will not share with a third party any login credentials to our Services. You are responsible for all users of your Hard Hat Hunter account, whether or not authorized by you. You agree to immediately notify Hard Hat Hunter of any unauthorized use of your account.
- Privacy
Hard Hat Hunter strives to provide the utmost privacy to its users. See our Privacy Policy for more information.
- Content
You own all of the content and information you post on Hard Hat Hunter. Any content that you share or post (including profile information, pictures, links, and job postings) may be seen by other Users. Content shared through our messaging feature “The Pipeline” will only be visible to the addressee(s).
- General Service Rules
- Agreement
By using our Services, you agree to the following:
- Your account must be in your real name without any false personal information. You agree to keep this information updated and current.
- If the administrators at Hard Hat Hunter disable your account, you will not create another account without Hard Hat Hunter’s express permission.
- You will not transfer your account to anyone without first getting Hard Hat Hunter’s written permission.
- You will not act dishonestly or unprofessionally, including by posting inappropriate, inaccurate or objectionable content.
- You will not access data not intended for you or logging into a server or account which you are not authorized to access.
- You will not harass, abuse or harm another person.
- You will not send spam or other unwelcomed communication to others.
- You will not act in a libelous, discriminatory or otherwise objectionable manner.
- You will not disclose any information that you do not have the right to disclose (such as confidential information of others).
- You will not post anything that contains software viruses, worms or any other harmful code.
- You will not harass, or advocate harassment of any group, company or individual.
- You will not collect, use, copy, or transfer any information obtained from Hard Hat Hunter without the consent of Hard Hat Hunter.
- You will not override any security feature of the Services.
- Disclaimer of Warranty
TO THE FULLEST EXTENT POSSIBLE BY LAW, HARD HAT HUNTER DOES NOT WARRANT THAT HARD HAT HUNTER OR HARD HAT HUNTER SERVICES WILL OPERATE ERROR-FREE OR THAT THE HARD HAT HUNTER WEBSITE AND ITS SERVICES ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF HARD HAT HUNTER OR HARD HAT HUNTER SERVICES RESULTS IN THE NEED FOR SERVICES OR REPLACING EQUIPMENT OR DATA OR ANY OTHER COSTS, HARD HAT HUNTER IS NOT RESPONSIBLE FOR THOSE COSTS. HARD HAT HUNTER CONTENT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. HARD HAT HUNTER, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. HARD HAT HUNTER MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE HARD HAT HUNTER CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS AND LINKS.
- Disclaimer of Consequential Damages
TO THE FULLEST EXTEND POSSIBLE BY LAW, IN NO EVENT SHALL HARD HAT HUNTER, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON ANY HARD HAT HUNTER SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE HARD HAT HUNTER OR HARD HAT HUNTER SERVICES AND THE HARD HAT HUNTER CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL BASIS, AND WHETHER OR NOT HARD HAT HUNTER IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- Limitation of Liability
TO THE FULLEST EXTENT POSSIBLE BY LAW, HARD HAT HUNTER’S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY HARD HAT HUNTER SERVICE OR YOUR USE OF THE HARD HAT HUNTER CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE) WILL NOT EXCEED $100.
- Disputes
If anyone brings a claim against Hard Hat Hunter related to your actions, your content or your information on Hard Hat Hunter, you agree to indemnify and hold hard Hat Hunter harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users’ actions on Hard Hat Hunter and are not responsible for the content or information users transmit or share on Hard Hat Hunter. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on Hard Hat Hunter. We are not responsible for the conduct, whether online or offline, of any user of Hard Hat Hunter.
Privacy Policy
User privacy is of vital importance to Hard Hat Hunter. We strive to provide users with a safe community in which to input their information. This Privacy Policy describes how Hard Hat Hunter collects and uses online data.
- Collection of Information
- Profile Information
When you join Hard Hat Hunter, you are required to provide us with your name, email address, and a password. Additionally, you must agree to our User Agreement and this Privacy Policy. You understand that by creating a Hard Hat Hunter account, Hard Hat Hunter and others will be able to identify you by your Hard Hat Hunter profile.
Additional information may be inputted to your profile such as job title, location, education, and work experience to provide you with more customized services. All information that is provided on your profile can/will be collected by Hard Hat Hunter.
- Use of Services
We also collect information regarding when you access our services, including how our services are accessed. The information concerning what aspect our services you utilize is also collected.
- Shared Content
Any content that you choose to share on Hard Hat Hunter is subject to collection, this includes messages, media (photos, videos).
- Network & Connections
Hard Hat Hunter collects information about the people and companies you are connected to and how you interact with them.
- Customer Service
When you contact Hard Hat Hunter to receive service support, we may have access to your profile information, messages, crew members and other contributions to our services and collect the information we need to assess and respond to your inquiry. We also use this information to track and identify potential problems to help improve our services.
- Device Information
When you visit our services, we receive the internet protocol (“IP”) address of your computer or the proxy server that you use to access the web, your computer operating system details, your type of web browser, your mobile device (including your mobile device identifier provided by your mobile device operating system), your mobile operating system (if you are accessing our services using a mobile device), and the name of your ISP or your mobile carrier. We may also receive location data passed to us from third-party services or GPS-enabled devices that you have set up, which we use to show you local information.
- Cookies
We use cookies and similar technologies to help us recognize you across platforms of our services. By visiting our services, you consent to the placement of cookies and beacons in your browser and HTML-based emails in accordance with this Privacy Policy.
- Consent
The personal information that you provide to Hard Hat Hunter may reveal, or allow others to identify, aspects of your life that are not expressly stated on your profile. By providing personal information to Hard Hat Hunter when you create or update your Hard Hat Hunter account and profile, you are expressly and voluntarily accepting the terms and conditions of our User Agreement and freely accepting and agreeing to our processing of your personal information in the ways set out by this Privacy Policy and the User Agreement. Supplying to Hard Hat Hunter any information deemed “sensitive” by applicable law is voluntary on your part. You can withdraw or modify your consent to our collection and processing of the information you provide at any time, in accordance with the terms of this Privacy Policy and the User Agreement, by changing your account settings or your profile on Hard Hat Hunter, or by closing your Hard Hat Hunter account.
- Use of Information
- Improvement and Development of Services
The information and content that Hard Hat Hunter collects are used to allow Hard Hat Hunter to conduct research and development to improve the services provided to you. We also use profile information and content for invitations and communications promoting our services that are tailored to the recipient.
- Legal
We may be required to disclose personal information, profile information or information about your activities as a member, or visitor, when required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce the User Agreement, investigate and defend ourselves against any third-party claims or allegations or protect the security, integrity or our services; or (3) exercise or protect the rights, property, or safety of Hard Hat Hunter, our members, personnel, or others. We attempt to notify members about legal demands for their personal information when appropriate in our judgement unless prohibited by law or court order or when the request is an emergency.
- Sharing Statement
We may share your personal information with our affiliates outside of the Hard Hat Hunter entity as reasonably necessary to provide the services. You consent to this sharing.
The visibility of your profile to other members of Hard Hat Hunter is restricted to other members of the Hard Hat Hunter community. Unless you delete them, your profiles on Hard Hat Hunter are always viewable on our services.
We do not rent or sell personal information that you have not posted on our services, except as described in this Privacy Policy. We will not disclose personal information that is not published to your profile or generated through engagement with our services, unless we have your separate consent or unless we have a good faith belief that disclosure is permitted by law or is reasonably necessary to: (1) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce this Privacy Policy or our User Agreement; (3) respond to claims of a violation of rights of third parties; (4) respond to member service inquiries; or (5) protect the rights, property, or safety of Hard Hat Hunter, our services, visitors or the public.
We support middleware providers that offer archiving solutions to firms subject to legal and regulatory archiving requirements, which, with your permission, facilitate the archiving of your communications and other activity by a third party for compliance purposes. Content distributed through our sharing features and third-party integrations may result in displaying some of your personal information outside of our services.
- Shared Information
- Polls and Surveys
Polls and Surveys may be conducted by Hard Hat Hunter. We may follow up with you via email or direct-messaging regarding your participation. We may use third parties to deliver incentives to you to participate in surveys or polls. If the delivery of incentives requires your contact information, you may be asked to provide personal information to the third party fulfilling the incentive offer, which will be used only for the purpose of delivery incentives and verifying your contact information. It is up to you whether you provide this information, or whether you desire to take advantage of an incentive. Your consent to use any personal information for the purposes set forth in the poll or survey will be explicitly requested by the party conducting it. You may opt out of participating in surveys.
- Search Features
You may search for users, jobs, information about companies and community content (including our blog at blog.hardhathunter.com). We use personal information from our services, including member and company profiles, to inform and refine our search service.
- Testimonials
If you provide any testimonials about our services, we may post those testimonials. They may include your name and other personal information that you have provided.
- Company, School and Other Entities’ Profiles
If you include a company, school, business, or organization in your crew, you will be listed among its crew members, which can be viewed by others including the page owner. We use aggregate information about these crew members to provide data about such pages performances.
- Disclosure to Others as the Result of a Change in Control or Sale of Hard Hat Hunter Inc.
We may disclose your personal information to a third party as part of a sale of the assets of Hard Hat Hunter Inc., a subsidiary, or division, or as a result of a change in control of the company or one of its affiliates, or in preparation for any of these events. Any third party to which we transfer or sell our assets will have the right to continue to use the personal and other information that you provide to Hard Hat Hunter in the manner set out in this Privacy Policy.
- Service Providers
We may employ third party companies and individuals to facilitate our services. These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to Hard Hat Hunter not to disclose or use it for other purposes.
- Data Retention
We retain the personal information you provide while your account is in existence or as needed to provide you with services. We may retain your personal information even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between members, prevent fraud and abuse or enforce this Privacy Policy and our User Agreement. We may retain personal information, for a limited period of time, if requested by law enforcement. Our Customer Service may retain information for as long as is necessary to provide support-related reporting and trend analysis only.
- Your Rights
You have a right to (1) access, modify, correct or delete your personal information controlled by Hard Hat Hunter regarding your profile; (2) change or remove your content; and (3) close your account. If you close your account, your information will generally be removed from the service within 24 hours. We generally delete closed account information and will de-personalize any logs or any other backup information through the deletion process within 30 days of account closure.
- Changes to this Privacy Policy
We may change this Privacy Policy at any time. If we make significant changes in the way we treat your personal information, or to the Privacy Policy, we will provide you with notice via our services or by some other means, such as email. Please review the changes carefully. If you agree to the changes, simply continue to use our services. If you object to any of the changes to our terms and you no longer wish to use our services, you may close your account. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. Using our services after a notice of changes has been communicated to you or published on our services shall constitute consent to the changed terms or practices.
- Security
We have implemented security safeguards designed to protect the personal information that you provide in accordance with industry standards. Access to your data on our services is password-protected. To protect any data stored on our servers, we also regularly monitor our system for possible vulnerabilities and attacks. However, since the internet is not an entirely secure environment, we cannot ensure or warrant the security of any information that you transmit to Hard Hat Hunter. There is no guarantee that information may not be accessed, disclosed, altered or destroyed by breach of any of our physical, technical or managerial safeguards. It is your responsibility to protect the security of your login information and account. Please note that emails, messaging via “The Pipeline” and similar means of communication with other crew members are not encrypted and we strongly advise you not to communicate any confidential information through these means. Please help keep your account safe by using a strong password.
